What is a Criminal Lawyer?

By: Amy Nutt

In law there are two basic types of off lawsuits: criminal and civil. Civil lawsuits are lawsuits between two private parties, often two people. Criminal lawsuits are lawsuits brought by the state or federal government against an individual or group. Civil cases are initiated by the victim, and criminal cases are initiated by the government through a prosecutor. Criminal lawyers are those who defend the plaintiff in criminal lawsuits.

What Criminal Lawyers Do

Criminal lawyers represent their clients in lawsuits that are initiated by the government. Their clients are individuals or groups who have been accused of acts that are crimes of some sort. It could be a misdemeanor, which is a less serious crime like drunk driving, or it could be a felony, which is a serious crime like murder that could end in jail time or even the death penalty. Many people think of felonies when they think of criminal lawyers, but criminal lawyers also represent plaintiffs who are facing misdemeanor charges.

Criminal Lawyers Early in a Defense

Many people who are being charged with a crime wait to hire a lawyer. Perhaps they think the charges will be dropped, or maybe they think that the potential punishment does not warrant the cost of hiring a lawyer. They may think they can represent themselves in an attempt to save money. Whatever the reason, this is a dangerous idea, because criminal lawyers can often be of the most help early in the process.

One way that a lawyer can help is by negotiating a dismissal of the case. Lawyers know how to spot potential weaknesses in the prosecutor's defense. Sometimes by presenting these weaknesses to the prosecuting attorney, they can help to negotiate a dismissal of the charge before the charges are officially filed.

A lawyer can also help a plaintiff by helping to negotiate a plea bargain. This involves an admission of guilt in return for a lessening of the potential consequences and an avoidance of the courtroom appearance. Many people charged with misdemeanors can avoid much of the expense of a court case by plea-bargaining.

Plaintiffs who are involved in crimes that are part of an ongoing investigation can use a criminal lawyer to help negotiate a lesser sentence in return for cooperation in the investigation. For instance, if a plaintiff knows information about another aspect of the crime that could help the prosecutors capture a high-profile criminal, the prosecutor may be willing to drop some charges in return for that information. A lawyer knows how to approach the police or the prosecutor to present this proposition.

Tips for Working with a Criminal Lawyer

If you are in a position where you need the services of a criminal lawyer, you need to work with your lawyer to ensure that your defense goes as smoothly as possible. Even if you are just facing minor charges, your lawyer is the only person who can help lower those charges and save you thousands of dollars and protect certain freedoms that you could lose with a "guilty" conviction.

No matter what, do not discuss your case with anyone other than your lawyer. Anything that you say about your case outside of your lawyer's office could be repeated in the courtroom. Your lawyer operates under "attorney-client privilege," which means that he cannot be forced to share with anyone what you tell him in confidence. Other people in your life do not have this protection.

Be honest and upfront with your lawyer. He cannot help you if you do not tell him exactly what happened, even if it makes you look bad. Answer all questions, and let your lawyer lead the defense. He knows how to best present the information so that you are honest, yet appear as guilt-free as possible to the jury or judge. Remember, your attorney is on your side, so treat him and his staff with respect as you work through your case.

Eleven Attributes Of A Good Criminal Defense Attorney

By: David Wise

People often ask me how to determine if a Criminal Defense Lawyer is good or not. Having practiced as a San Francisco criminal defense attorney throughout California for thirteen years I have developed some opinions about this, which are laid out in the eleven rules below. These attributes can help make the difference between a good, bad or mediocre result. Remember that good criminal defense lawyering is as much an art as a technical skill. There is no substitute for experience. On the other hand it is unfortunately true that some veteran lawyers are tired of practicing law or have been doing it the wrong way for so long, they can't change their ways. These rules apply to all criminal cases, whether drunk driving, driving under the influence, drugs, fraud, assault, battery, domestic violence or others. Of course they are no different whether you are looking for a San Francisco criminal lawyer, an Oakland lawyer, Hayward lawyer or a lawyer from another part of the country. The rules apply everywhere.

1. The lawyer must care about the result and the client's well being:

This may seem obvious but it is important for lawyers to remember how important a case is to the person charged with a crime. Criminal charges can bring intense stress in all areas of a person's life, including professional, financial and family life. This rule applies whether it is a simple DUI matter or a serious fraud or homicide allegation.

2. Get to know the client and his or her life situation and background:

I cannot tell you the number of times that the unique facts of a persons life, or stresses which they are under, strike a note of sympathy with judges when negotiating the outcome of a case, or at sentencing. More importantly these facts can make a big difference with a jury should a person accused with a crime chose to testify in his or her own defense.

3. Work quickly to try to get the person out of jail:

Needless to say, if a person is in jail and hires a criminal lawyer, they are expecting the lawyer to make every effort to gain their release from jail. There are several things that can be done by the criminal defense attorney to make this happen, including motions to set or reduce bail, motions for release on their own recognizance, or, in the case of a San Francisco criminal lawyer or San Francisco criminal defense attorney, a request for supervised release. For some people that own property, a motion to post real estate in lieu of cash is a good way to avoid paying a ten percent premium to a bail bondsman.

4. Consider the effects of a criminal case on a person's profession, or future profession:

Many convictions can result in the loss of business or professional licenses. Any trade that requires a state license, including hairdressers, nurses, landscapers, and many others, will be in jeopardy if you face criminal charges. Knowing what you are able to accept as part of a plea bargain, or if you are able to plea bargain at all, is critical to making the right choice in your case. Any criminal defense attorney, whether a San Francisco criminal lawyer, Oakland lawyer, Hayward lawyer or other, should be aware of this.

5. Remember confidentiality:

It is important for a criminal lawyer to understand the privacy of the client. This is especially so when dealing with family members of the person charged with a crime. Family may mean well when asking questions, but unless the client authorizes the attorney to talk about it, anything said about the case should remain private and confidential.

6. Consider any immigration consequences:

Anyone who is not a citizen must be especially careful when facing criminal charges. Any conviction or even an admission without entry of a judgment, can result in deportation, exclusion from re-admission or denial of citizenship. This is unfortunately a highly misunderstood area of the law by many criminal lawyers. Understanding these rules is critical whether you are dealing with a San Francisco DUI attorney, San Francisco criminal lawyer, San Francisco criminal defense attorney, Oakland DUI lawyer, Hayward or any attorney from elsewhere in the country.

7. Communication with the client:

Part of why a person hires a criminal lawyer is to understand what is happening in the case as it goes along. A criminal defense attorney must talk about it with the client on a regular basis.

8. Investigation:

In most cases the client should allow the criminal defense attorney to hire an investigator to interview witnesses. If the police did it to gather evidence against you, why wouldn't you want to do it in your own defense. It costs money but it would be "penny wise and pound foolish" to skimp on this part of your defense - that is, unless you agree with the police version of the facts.

9. Legal research and motions:

Any San Francisco criminal defense attorney must be sure to understand the "elements" of an offense, that is, what the prosecutor has to try to prove in order to get a conviction. Many times the prosecution cannot do it, but you wouldn't know it unless you looked at the precise elements. Also many searches resulting in police finding drugs or other contraband are illegal and should be challenged by the criminal lawyer.

10. Negotiation:

The way in which a criminal defense attorney negotiates a case can make the difference in a good or bad result. Bear in mind that not all cases can or should resolve by negotiation. Sometimes your best option is to fight the case all the way to jury trial.

11. Trial

Only about five to ten percent of cases go all the way to jury trial. However for the case that we think we can win, jury trial is usually the best option. On the down side, it is more expensive. That is because it should take intensive preparation for the lawyer. It can be stressful and time consuming for you, the client. But when you win, you walk out the door with no conviction on your record. If the judge and prosecutor refuse to offer you a reasonable alternative, and if you have a workable case, jury trial can be the only smart option. Before a jury is where the true lawyer shines as an advocate. Too many a San Francisco criminal defense attorney and San Francisco DUI attorney has not done enough jury trials, fears going to trial, or has had no success before juries. This is true for attorneys in most locations. Trial should not be rushed into heedlessly. Some cases should not go to trial. But trial should always be an option that you discuss with your lawyer, and your lawyer should appear knowledgeable about the ups and downs of jury trial.

Federal Criminal Defense Lawyers for Internet Crimes: A New Breed of Attorney

Author: Bill Douglas

There’s a whole new niche for criminal defense attorneys – internet crimes. One of the most common is identity theft. It is one of the most common crimes committed via the Internet. However, it is not a crime that was invented by the internet. It’s just that the internet has made it easier to commit it. And, the stats are staggering. Proof?

According to a May 2009 report by the Congressional Research Service:

It [identity theft] is the fastest growing type of fraud in the United States; in 2008 about 9.9 million Americans were reportedly victims of identity theft, an increase of 22% from the number of cases in 2007. In addition, the Federal Trade Commission (FTC) estimates that it costs consumers about $50 billion annually.

Criminal Defense Lawyers for Internet Crimes: A Thriving Niche?

The report goes on to say that identity theft is usually committed in concert with other crimes, eg, “credit card fraud, document fraud, or employment fraud.” So while greed may play a major factor, it’s not the only factor. Sometimes the accused may be trying to secure a job and in doing so, wants to hide a criminal record, for example.

In light of situations like this, it’s easy to see why criminal defense lawyers who specialize in internet crimes are perhaps one of the fastest growing niches.

Internet Crimes Penalties: Why to Seek the Counsel of Experienced “e- Criminal” Defense Lawyers

These can range from a slap on the wrist to significant time behind bars. It all depends on the amount of goods and/or property that was stolen, and a defendant’s previous record. Practically every year, new legislation comes down the pike as the law seeks desperately to catch up with technology.

If you find yourself charged with an internet crime, you should seek the counsel of criminal defense lawyers who specialize in this area -- especially since the laws in this area are constantly evolving.

Some of these are crimes that have been committed either on federal property or to federal property. What Criminal Attorney's Charge Is A Crime

By: Tom Sample

If you've been falsely accused of a crime, it's likely you don't think any price is too high to pay for your freedom. But, when money does matter, it's important not to sacrifice the quality of your criminal attorney just to meet a budget.

If you are truly innocent, it's very likely a good criminal attorney can get you off. Going for a discount rate wouldn't be wise, but there are ways to keep costs at a minimum or even recoup them after a win in court. As long as you insist on finding a criminal attorney that displays some basic, but very important, traits, you should be okay with your hire even if his or her rates are less than others.

Should money be an issue in hiring a criminal attorney, consider these things:

  • Stay clear of the 'best of the best' if you can't afford them. Instead, settle for a criminal attorney that displays the traits of a good criminal defense lawyer. This means someone with years of experience in the law, a person who has perhaps also been a prosecutor and maybe even someone with a minimal (but existent) track record in trial courts. Newer criminal attorneys are likely to cost less, but that doesn't mean they'll be awful. Trial experience and former prosecution work are vital traits in that they ensure the criminal attorney you're thinking of hiring knows his or her way around a criminal case.
  • Consider going with the attorney provided you by the courts if: that attorney has a good track record, shows a genuine concern about you and your case, really seems to believe your side of the story. If these three things are not present, you might want to try and hire a criminal attorney on your own if it's at all possible. Public defenders can be fantastic lawyers, but that doesn't mean all of them are - just like private criminal attorneys.
  • Find a lawyer with a good background who is willing to wait on payments until the case's outcome is decided or is at least willing to work with you. Some lawyers will work on a retainer that's fair and wait to recover costs for false arrest at a later date.
  • Plan to recover costs if you clearly are not guilty of the crime you've been accused of.

As you look for a criminal lawyer, remember there are certain traits to look for. You want a criminal lawyer who:

  • Has experience in the field.
  • Understands how the prosecution works.
  • Is versed in trial law, as well.
  • Is open with the lines of communication and clearly listens to you and your input on the case.
  • Treats you like a person and not a 'criminal.'
  • Keeps you apprised of the case as it progresses.
  • Fights for your side without prejudice.

Finding a good criminal lawyer can be a costly venture, but there are ways to keep it more affordable without sacrificing quality. If you make sure experience and communication are present with your criminal lawyer, you should be okay even if you haven't been able to hire the 'best of the best.'

How to Spot the Best Criminal Defense Attorney

By: Mark Sierra

When it comes to protecting your rights and freedom when charges have been placed against you, your choice should be the best criminal defense attorney that you can find.

The things the best criminal attorney can do for you are to restore your reputation and preserve your freedom. They can deter some arrest records from ever being filed if proper measures have been taken. They also will understand the local system and the participants with whom they will be doing business with. This can be ideal if a plea bargain is your chosen path.

The best criminal defense attorney could be a former judge or possibly a former prosecutor. This could be a considerable advantage having them on your side because they can offer you their experience into how things work. They know better than anyone what challenges you face. The tactics that are involved with each case can be numerous and the best criminal defense attorney has to be not only prepared for this, but knowledgeable on how to properly deal with them.

When choosing your defense attorney, find one that can focus on your case with a reasonable level of attention. Ask them to provide references from previous clients. Ask for any news clippings or websites where the lawyer's performance has been cited as an example of a job well done.

They will take care of all the different levels of information with the same attention to detail that is necessary to win. Make sure your defense attorney knows how to communicate not only with you, but with the court system. If you are having difficulty staying in contact with your lawyer, then so might the court system and their staff. This could result in a missed opportunity that could have helped your defense. If at all possible, try to set a regular time to meet or be contacted to review progress.

When it comes to fighting for and protecting not only your rights, but freedom and possible life, your choice of the best criminal defense attorney will make the difference in a positive or negative outcome.

The purpose of criminal law attorneys is to assist those who have been charged with a criminal offense. They assist by helping those charged get acquitted of the charge or by getting them a less severe penalty or sentence. How much they can help is dependent on the nature of the crime and the level of guilt and past criminal record of the person charged.

Criminal law attorneys defend all kinds of people regardless of the crime they were charged with, whether they are guilty or not. It is their job to prove their client innocent, even if they know the client committed the crime. Good criminal law attorneys will fight for you and believe in your innocence.

It is their job to make sure you do not get a conviction, because you are innocent until proven guilty. They will inform you of how you stand legally and will advise you on the best course of action. The Benefits of Obtaining a Criminal Defense Lawyer

By: George Kline

If you are in the unfortunate position of being charged with a criminal offense, it is essential that you retain good criminal defense lawyers immediately to preserve your rights. There are many factors that go into a criminal charge, and your defense law firm will have specialist attorneys and staff that are experienced and who can dig deep into any factor that is part of your case.

Criminal charges may be brought against a person for many reasons, from DWI/DUI traffic violations, drug offenses, white collar crimes, and personal injury cases such as assault, theft, or sex crimes. These crimes can involve incarceration and felony charges, and you would need an aggressive defense to reduce or eliminate them on your behalf.

Criminal defense lawyers know the US and Minnesota laws pertaining to these serious charges and can help you. If violence is involved, or threat of violence, or even a hint to cause harm, you could find yourself locked behind bars for years. Criminal charges can be brought for crimes against a person, or a business, or for theft from a person or business. Larceny, robbery, and burglary penalties can vary according to the value of items involved. An aggressive defense is required to defend yourself against unfair charges and extreme sentences.

Much has been in the news lately about white collar crimes, and the damages caused by internal sabotage, insider trading, fraud, computer crimes and embezzlement. What a person may think only hurts a business can actually harm many more humans in the process. A trial for these matters also demands an aggressive defense against harsh sentences.

For drug offenses, unlawful possession, sale, or use of banned substances can result in jail time. Growing, manufacturing, or making narcotics will have similar penalties. These crimes can put you away for decades, as they are serious offenses. Each case is different, but your experienced group of criminal defense lawyers can sort out the details to help you in court and on appeals.

A crime that will restrict your freedom is serious, and having a team of attorneys who will pursue every avenue of knowledge in such matters is exactly what you need when you appear in court to answer the charges against you. A team that knows and has successfully handled appeals on criminal charges may be able to help you. They are aware of court procedures and restrictions and deadlines involved that must be followed to the letter.

You cannot defend yourself against criminal charges. There is an old saying that the person who defends himself has a fool for a lawyer. Do not lose your freedom or rights because you hesitated in contacting criminal defense lawyers. The time to bring in your defense team is immediately, at your first available call. They will go the extra mile for you, no matter how difficult the trial, or the defense seems to be.

When the chips are down, and you stand alone in the courtroom to face criminal charges, you want to know that you have presented the best defense case possible. Your criminal defense lawyers can give you the best chance possible when you are faced with a criminal offense.

The information you obtain from this article is not, nor is it intended to be, legal advice. You should consult an attorney for individual advice regarding your own situation.
